US Department of Labor Receives Comments from Nonprofits

The National Council of Nonprofits submitted comments to the US Department of Labor regarding overtime regulations. The Council's comments requested that:

  1. the DOL NOT carve out a separate, sub-minimum salary level for nonprofits; and
  2. that DOL create a re-opener process so that nonprofits with government grants and contract can re-coup the costs of any change in federal law.

Last month, a federal judge in Texas ruled in State of Nevada v. U.S. Department of Labor that the Overtime Final Rule issued by the Obama Administration is invalid because the U.S. Department of Labor exceeded its authority. The Overtime Final Rule would have reclassified four million workers and made them eligible for overtime pay.
